Employer Must Pay Accommodation Allowance

ABU DHABI - The employer must pay accommodation allowance if the employee is not provided housing, or else the Ministry of Labour will not issue a work permit for the expatriate worker, according to ministry officials on Monday.

The Disputes Committee clarified the condition at the open day on Monday and approved the work permit of a driver after verifying that he had been provided with suitable accommodation apart from his monthly salary.

The Ministry of Labour, however, rejected a request of an Arab employee for waiving of the six-month labour ban following a dispute with his company. The dispute had ended with the court verdict ordering the company to pay him Dh17,000 as his end-of-service benefits. The company was asked to bear the cost of repatriating him to his home country.

The verdict did not refer to the right of the employee for transferring his sponsorship to another employer.

An official said, ‘The basic rule is enforcing the six-month ban on the employee whose services were terminated before completion of the contract. And in case of a labour dispute, if the two parties refuse to settle through the ministry, it will be referred to the court.’

The Ministry will only carry out the court verdict.
